What If RTDRS Hearing Time Doesn’t Work?

The RTDRS has scheduled a time and date for the hearing filed by the landlords/agents to terminate the lease due to unpaid rents. The tenants (the respondent) would prefer a different time. What can they do?

If the tenant (respondent) wants to request a different time for the RTDRS (Residential Tenancy Dispute Resolution Service) hearing, they can apply for an adjournment or rescheduling. Here are the steps they can follow:

  1. Contact RTDRS: The tenant should promptly contact the RTDRS and explain why they need the hearing to be rescheduled. They may need a valid reason, such as a scheduling conflict, health issues, or other compelling circumstances.
  2. File a Request for Adjournment: The tenant can submit a formal request for an adjournment through the RTDRS system. This is usually done by filling out a specific form that asks for a new date and explains why the change is necessary.
  3. Timing: It’s essential to submit the request as early as possible. If it’s too close to the scheduled hearing date, the RTDRS might deny the request unless there’s a very urgent or serious reason.
  4. Provide Evidence: If possible, the tenant should provide documentation supporting the reason for the change (e.g., medical appointments, work conflicts, etc.).
  5. Await Response: The tenant will need to wait for the RTDRS to respond to the request. The RTDRS may grant or deny the request based on the circumstances.

If the request is denied, the tenant may still attend the hearing at the originally scheduled time or explore other legal options.
